Guaranteed Issue Rights

When you have a guaranteed issue right, an insurance company:

  • Cannot deny Medigap insurance coverage or place conditions on the policy
  • Must cover all preexisting conditions
  • Cannot charge more for coverage because of past or present health problems
Plan Options

Generally, a guaranteed issue right does not entitle you to select from all the available Medigap plans. In most cases, you may select from only a certain group of plans.

Time Limit

In order to protect your guaranteed issue right, you must apply for a Medigap policy within a specified period of time, which is usually shorter than the 6-month Medigap Open Enrollment Period.

Let's take a closer look at each of the situations in which a guaranteed issue right would apply.
