You cancel your current Medicare + Choice
plan, Medicare SELECT policy, or Medigap policy because your insurance
company has committed fraud. For example, the marketing materials were
misleading, or quality standards were not met.
In this situation, you leave the health care plan because it failed
to meet its contract obligations to you. Generally, you must file a grievance
with the health care plan, Medicare, or the state insurance department
and receive a favorable decision that the plan is at fault before you
have this right.
Plan Options
You have the right to buy the Medigap Plan A, B, C, or F that is sold
in your state.
Time Limit
You must apply during the period that starts 60 days before you leave
your plan and ends 63 days after your coverage ends.
