Private Contracts with Providers

A private contract is an agreement between you and a health care provider who has decided not to provide services through the Medicare Program. The private contract applies only to services delivered by the provider who asked you to sign the contract. You cannot be asked to sign a private contract for emergency or urgently needed care. You also have the right to see other Medicare doctors for services.

If you sign a private contract with a provider:

  • Medicare and Medigap will not pay for the services you receive from the provider, so you should not submit a claim form

  • You are responsible for paying the charges requested by the provider

  • The provider cannot bill Medicare for services for any person with Medicare for 2 years
